Terms & Conditions of #VIVEPORTAL

  1. “2 Days in the Future” or the #VIVEPORTAL giveaway contest is a social media Campaign created by HTC for the VR community.
  2. This Campaign is not sponsored by any social media platform.
  3. The Campaign will run for a total of four weeks. (from July 26th, up to August 22th at 11:59 PST)
  4. To participate for a chance to win the final prize, you must be 18 years of age or older.
  5. All the finalists will be chosen by HTC within thirty (30) days after the end date of the campaign, and winners may be decided by HTC or the VR community. (based on HTC’s discretion)
  6. Winners will be asked to sign an additional agreement before receiving the giveaway.
  7. Each person is only allowed to enter the Campaign once. Multiple sign ups by a single entity are not permitted.
  8. There is no entry fee and no purchase necessary to enter this competition.
  9. The prize of the contest is a complimentary trip (economy flight) and 2 nights stay at a 5-Star Hotel equipped with the VIVE Pro 2, VIVE Focus 3, and VR arcade tools. There will be a complimentary stay package from the hotel during the two days. The prizes totals up to approximately $4800 in value. The exact hotel venue will be revealed at the end of Phase 1 (August 8th, 2021). Some prizes will be provided by the 5-Star Hotel, please visit [weblink] and refer to the service agreement.
  10. Contest begins on July 26th, 2021 and ends on August 22th, 2021. After this date there are no further entries permitted to the competition. The Sponsor reserves the right to change the beginning or end date.
  11. No responsibility can be accepted for entries not received for whatever reason.
  12. The Sponsor reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Sponsor’s control. Any changes to the competition will be notified to entrants as soon as possible by the Sponsor.
  13. The Sponsor is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
  14. No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
  15. The winner will be notified by email within 30 days of the closing date with instructions on how to claim the prize. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner or cancel the prize.
  16. Cheating for entries in any way (referring yourself using different emails or similar tactics) will disqualify you from winning the contest.
  17. The Sponsor’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
  18. By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
  19. The competition and these terms and conditions will be governed by United States law and any disputes will be subject to the exclusive jurisdiction of the courts of the United States.
  20. The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current USA data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
  21. Entry into the competition will be deemed as acceptance of these terms and conditions.
  22. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social network. You are providing your information to HTC and not to any other party. The information provided will be used in conjunction with the United States standard Privacy Policies.
  23. Employees of HTC or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.

Format

At a glance

  • The VR community will guess the prizes of the Campaign (Rounds 1, 2 and 3)
  • Then, people will need to create their own content for a chance to win (Round 4)
  • The Campaign will run for a total of four weeks (from July 26th, up to August 22th at 11:59 PST). The first two weeks for Rounds 1, 2 and 3, and the final two weeks for Round 4

I’m a VR Influencer. How do I win?

In Rounds 1, 2, and 3, your audience will need to guess what the full giveaway is by replying to our posts on social media and tagging you . Our posts will lead you and your audience to several clues hidden in online content.

The influencers that get tagged the most in post with the correct answers using the hashtag #VIVEPORTAL will be advanced to the next rounds (if you are in our Top 100 VR Influencers List , you will get a head start).

25 influencers will qualify for Round 2, and only 10 will make it to Round 3. After Round 3 is over, we will choose the 3 winners with the most tags on posts with the correct answers.


I’m part of the VR Community. How do I win?

In Round 4 , The VR Community will be asked to stretch their creativity by creating posts and videos. The judges at HTC will select finalists. Then, the community will vote for which finalists they like. If you are a finalist and get the most community votes, you win!


How do I guess the giveaway?

The answers will be found in different online content related to HTC. We will release cryptic clues periodically throughout the first two weeks of the Campaign (to influencers as well as on our social media).

Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

  1. Eligibility: The #VIVEPORTAL COMMUNITY COMPETITION (the “Campaign”) is open to legal residents of the following countries who are at least eighteen (18) years old at the time of entry (the “Eligible Residents”):

    United States, Canada (excluding Quebec), United Kingdom, Germany, France, Sweden, Netherlands, Australia, New Zealand, Taiwan, South Korea, Switzerland, Norway, Poland, Austria, Belgium, Russia, Thailand, Singapore, India, Argentina, Brazil, Finland, Hong Kong, Ireland, Italy, Portugal, Romania, Spain, Brunei, Bulgaria, Burma, Cambodia, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Greece, Hungary, Iceland, Indonesia, Laos, Latvia, Lithuania, Luxembourg, Macau, Malta, Malaysia, Peru, Philippines, Slovakia, Slovenia, Uruguay, Vietnam, Mexico and Japan.

    Employees of HTC America, Inc. and its parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Non-natural persons (including corporations and other business entities) are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, municipal, territorial and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Campaign. Winning a prize is contingent upon fulfilling all requirements set forth herein.

    HTC will consider anyone using the hashtag #VIVEPORTAL as an opt-in to the Campaign. However, participants can always opt-out at any time by sending us a message via social media accounts.

  2. Sponsor: Al Habtoor Group, Al Habtoor City, Sheikh Zayed Road, Dubai, United Arab Emirates.

  3. Timing: The Campaign begins on July 26th, 2021 at 8:00 a.m. Pacific Daylight Time ("PT") and ends on August 22th, 2021 at 8:00 a.m. PT (the "Campaign Promotion Period").

Submissions

People in the VR community will upload content to social media in text, image, or video format as indicated by HTC in their official posts on Instagram, YouTube, Twitter, and Facebook.

Participants should not expose themselves or others to any dangerous or harmful behavior or activity at any time during the Campaign. Participants agree to abide by any and all applicable local, city, state, provincial and federal laws of their respective countries. Void where prohibited or restricted by law.

The submissions may not contain references which are obscene, crude or vulgar, and/or which contain gang identification, references to commercial products unless approved and asked for by HTC Staff, license plate numbers, phone numbers, personal addresses (physical or email), derogatory characterizations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behavior or conduct, or any other references that could be considered inappropriate, unsuitable or offensive, as determined by HTC Staff, at its sole discretion.

Submissions should be original works, and not copied, forged, manipulated or altered, unless Participants are specifically asked to do so by the HTC Staff.

You shall not upload submissions that were created by another person. Any person that is caught submitting another person’s content shall be eligible for disqualification. You may not submit any content that was taken in previous events (from HTC or other parties). Any person that is found to be submitting items that were created before the Campaign is eligible for disqualification.

Submissions which are inaccurate, irregular in any way, or otherwise not in compliance with these Terms & Conditions could be discarded at HTC’s discretion.

Winner Selection

All the finalists will be chosen by HTC the week after August 22th, and winners may be decided by HTC or the VR community (at HTC’s discretion).

Sponsor’s decisions as to the administration and operation of the Campaign are final and binding in all matters related to the Campaign.

Potential Campaign winner(s) will be notified by HTC via the social media platform they used to upload the winning content. Each potential winner will be required to respond to HTC’s notification with the requested information within fourteen (14) days of the date notice or attempted notice is sent.

If a potential winner of any prize cannot be contacted, fails to provide the requested information within the required time period or cannot accept the prize, the potential winner forfeits his/her prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event a potential winner is disqualified for any reason, HTC will award the applicable prize to an alternate winner based on their scores/rank in the finalists list. Alternate winners can only be selected from the finalists list published by HTC, after which the prize(s) will remain un-awarded. Prizes will be fulfilled after winner confirmation by emailing the winner to redeem the prize by following the included instructions.

Winners will be asked to sign an additional agreement before receiving the giveaway.

Prizes

No cash or other substitution shall be permitted. Sponsor will not replace any lost or stolen prizes. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes. If a prize is mailed, the winner assumes the risk of the prize’s safe arrival.

Retail value of the prize package is the standard MSRP, which shall be made available by HTC after the announcement of the giveaway on August 6th, 2021.

The Prize is non-transferable and no substitution will be made except as provided at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

Release: By receipt of any prize, winners agree to release and hold harmless Sponsor and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Campaign or receipt or use or misuse of any prize.

Publicity

Except where prohibited, participation in the Campaign constitutes each winner’s consent to Sponsor’s, and their agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state (and/or province) for promotional purposes in any media, worldwide, without further payment or consideration.

General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Campaign, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Campaign, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Campaign or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Campaign may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Limitations of Liability

The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, typographical errors, printing errors or by any of the equipment or programming associated with or utilized in the Campaign; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Campaign; (4) technical or human error which may occur in the administration of the Campaign or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Campaign or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Campaign, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Disputes

Except where prohibited, entrant agrees that: (1) the Campaign is governed by the laws of Washington State and that all federal, state, and local laws and regulations apply; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Campaign, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Campaign, shall be governed by, and construed in accordance with, the laws of the State of Washington without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.
